4. KING TIPPING

4.1 The intention of KiNG Tipping is to allow users to supply racing information online which is then presented on a “ladder board”. The users make their information available in the form of names of horses, the location and time of the race in which they believe a horse (or “runner”) will receive first placing. This information is available to be purchased by users if they meet conditions associated with been listed on the ladder board.

5. USE OF KING TIPPING

5.1 KiNG Tipping allows horse racing information to be provided to users. The information on KiNG Tipping is not directed at residents of any particular country outside Australia and is not intended for publication in, or use by, any person in any country or jurisdiction where such publication or use would be contrary to local law or regulation. 5.2 Users who wish to access information, known as “Tips” must purchase this information from another KiNG Tipping User from an area known as the “ladder board”. If we provide you with a username and password it is your responsibility to keep them secure and confidential. 7.2 The user will have a responsibility to provide horse racing information to the best of their knowledge.

7.3 A user which has been consistently entering tips which are deemed as similar to the tips that they have purchased from other users will have their account suspended. Techniques have been put in place to automatically determine such users based on their IP address, purchases, tips entered and payment details.

7.4 The user must add their tips before the tips 'lock down' which is typically 20 minutes before the 1st race of the day. The user cannot remove their tips which have been added once a purchase has been made. Under no circumstances can information be modified after the tips have been locked down.

7.5 Users have the option to send emails which will provide a weblink and a summary of their racing tips entered for purchase by other users such as friends or family.

7.6 Any users providing information either on their site, or via email to their subscribers that is detrimental to KiNG Tipping will have their account suspended without notice.

7.7 Users are encouraged to promote their service however any user found using Spamming techniques will have their account suspended without notice.

7.8 KiNG Tipping reserves the right to suspend an account in the event of suspected fraudulent activity.

7.9 The user is aware that a percentage of their sales made will be paid to KiNG Tipping, currently 30% for individual sales, 40% for subscription sales and 50% for Insider Selections.

7.10 You will be issued with a Username and Password to access and enter the information on the web site. If it should be discovered that any member is sharing their password with another person or passing on information to any third party then their account will be ended immediately.

7.11 The service is intended for personal use only and is not transferable. No part of the service may be reproduced, displayed in public, broadcast or used for any other purpose.

7.12 Payments for the sale of any tips will be paid in the form of an Australian cheque posted to an Australian address. For users outside of Australia cheque payment must be arranged to an Australian account.

7.13 Payments will only be made out to users at their request and with a balance of $25.00 or above. A payment fee of $1.40 will be charged when requesting payment to cover our administration costs.

8.1 You must be over 18 years of age to purchase tips via the KiNG Tipping. You should comply with the law in your country concerning the age at which a person is allowed to gamble.

8.2 Tips may be offered seven days a week. There may, however, be some days when no tips can be advised. You will make your own decision as to whether you choose to gamble based on these tips. All races/events considered will be in the Australian region.

8.3 The user is aware that a percentage of their purchases, currently 70% for individual purchases, 60% for subscription purchases and 50% for Insider Selections made will be paid to the seller.
